I think this demand for refund explains my experience. Desperately trying to recoup my $1200 deposit and am being ghosted.
(Email) Good morning,
On June 6, 2024, I sent the attached package to the address on your invoice via certified mail. On June 8, 2024, the USPS reported the attempt as "Addressee Unknown" and the letter is in route back to my return address. In addition to attaching the letter, I've also copied the message in this email. You have again failed to respond to me and your avoidance and failure to perform work will not be tolerated. I am demanding immediate return of my deposit. Please confirm receipt and facilitate this immediately to avoid legal action that I am more than prepared and willing to pursue.

Dear Honeycomb Building Solutions LLP c/o Richard Edward Johnson,
The purpose of this letter is to formally request a refund in the amount of $1,200.00, for the deposit that was paid on March 21, 2024, for work fence panels that have not been received or installed.
The refund is being requested due to failure to perform work as promised. The contract included removal of existing wood fence at back of property, installation of 90' of vinyl fencing, installation of double gate at backyard entry right side of house, trim trees and bushes back to keep off new fence.
It was agreed that the work was to be completed as soon as 811 marked utility lines. On 3/26/24, 811 was contacted and lines were marked by 3/29/24. To date, work has not been performed. You have continuously failed to begin work when promised and have not fostered open and honest communicate with me. I have continuously followed up with you for updates and have been promised start dates on 9 separate occasions. On each of these dates, you have failed to perform work a promised. Dates scheduled include, but are not limited to:
1.) 4/08/24 "will be starting your fence this week"
2.) 4/17/24 "we will start on your fence Friday (4/19)”
3.) 5/03/24 "going to start fresh Monday (5/6)”
4.) 5/07/24 "going to start on it tomorrow (5/8)"
5.) 5/10/24 Customer asked for refund - "will come back in about a week or so"
6.) 5/20/24 "would like to start on it this weekend (5/25)”
7.) 5/24/24 "we're starting this weekend (5/27)”
8.) 5/29/24 I stated if not finished mid-week next week I would take action to get $ back “clearing up something personally and then I’ll be there”
9.) 6/02/24 “I will start Tuesday (6/4)”On 5/10/24, I asked if you’d like to refund me rather than perform work. You stated that you would be back to perform work and have failed to do so. I communicated with you last week that if it were not completed by today, I would take action to get my money (deposit) back. I have been more than patient up to this point and do not trust that you will complete this job, or are capable of completing the job, to the standard in which you promised. Please consider this as a final demand letter to refund my money. If a refund is not administered by July 5, 2024, a court filing may be filed against you. In addition to the refund amount, a request for reimbursement of filing fees, attorney’s fees, and any other costs associated with obtaining the refund amount may be pursued.
